Acceptance of Terms and Conditions
The following terms and conditions (“T&C”) will govern your access and use of SESB Self Service Customer Portal (“mySESB”). By accessing and using mySESB, you have agreed to be bound by the T&C including any amendments made thereto. We reserve the rights to amend the T&C from time to time and by continuing to use mySESB, you are deemed to have read and agree and to be bound by the T&C and its amendments.
Description of mySESB
By using mySESB, you are able to perform any of the following transactions or activities:-
• to view the electricity bill presentment
• to pay the electricity bill
• any other transactions or activities may be made available by SESB from time to time
Termination of Access and Use
SESB may at any time at its absolute discretion to limit, suspend or terminate your access and use to mySESB without notice. The copyright, disclaimer and privacy statement shall survive on the suspension or termination of such access and use of mySESB.
Copyright
SESB owns and reserve all the intellectual property rights in relation to the content including but not limited to any text, software, music, sound, photographs, video, graphic, designs, marks and other material contained in this website. You may view the website and its contents using your own web browser, save and electronic copy or print out a copy provided that:-
• you do not modify the contents as it appears on the website
• you do not reproduce, transmit, broadcast and adapt any part of the website for any purpose which is not expressly permitted by SESB
• you do not use any information in the website for commercial use and/or personal gain or for any other purposes unless expressly permitted by SESB
• you accept that no ownership rights from downloading copyrighted material
You shall be solely liable for any loss, damage, cost and expenses resulting from any infringement of copyrights, proprietary rights or any other harm resulting from such breach.

MySESB and the website where mySESB is hosted or made available may contain links to third party websites and/or services that are not owned and controlled by SESB. SESB disclaims responsibility whatsoever for the content, privacy policies and practices of the third party websites and/or services.
By clicking any of the related links of the third party websites and/or services, SESB’s privacy policy ceases to apply here onwards and SESB shall not be responsible for any information shared and disclosed by you to the third party through any communication or interaction in connection with mySESB. You shall read the terms and conditions of the third parties websites including the privacy policies of the linked websites and/or services prior to sharing any such information.
Disclaimer
The use of mySESB is at your sole risk. Neither SESB nor any of its respective directors, shareholders, employees, agents and third party contents providers, consultants or licensors warrant that mySESB are free from any error, malfunction, breakdown, disruption, defect and any otherwise howsoever occurring. MySESB and the contents are provided on an “as is’ basis. SESB, its respective directors, shareholders, employees, agents and third party contents providers, consultants or licensors expressly disclaims all liability for all claims, losses or damage of any kind whatsoever direct or indirect whether attributed to, caused by or resulting from -
1. any malfunction, defect in and/or breakdown, disruption and/or unavailability of mySESB partially or wholly;
2. any malfunction, defect in and/or any breakdown, disruption or failure of any telecommunications, computer, terminal, server or other device or system whether or not owned, operated or maintained by you, SESB or any other party
3. failure of any such equipment or system to accept, recognize or process any instruction or username and password;
4. any of mySESB not being accessible, available and/or functioning;
5. any failure or delay caused by your internet browser or the software, computer virus or related problems;
6. the corruption, destruction, alteration , loss of or error in your instructions or any data or information in the course of transmission; 7. any loss, theft or unauthorized use of your username and password
8. any inaccuracy or incompleteness of information, data or instructions given by you in relation to any transactions or the performance of any transactions or otherwise in relation to the provision of any of mySESB;
9. your failure, neglect or omission to act in accordance with these terms and conditions and any other rules, regulations, policies and guidelines currently in force;
10. any event of which is beyond SESB’s reasonable control
11. any loss caused by third parties; and/or
12. any event of force majeure including but not limited to fire, earthquake, flood, lightning, riots, strikes, lockouts, government action, war, disruption of electrical or power supply.
Indemnification
You agree to indemnify and hold harmless SESB and its respective directors, shareholders, employees, agents and third party contents providers, consultants or licensors from and against all loss, damage, claims or expenses, including solicitors’ fees arising out of the use of mySESB or breach or violation of the T&C by you.
Privacy Statement
By using mySESB, you may or will be required to provide your personal data information. The information collected by SESB will be retained and used for the purpose of providing mySESB to you. We will not divulge or disclose your information to any third party except as authorized by you or required and/or permitted by under any law. SESB does not have any control over your information that is processed by a third party including further disclosure of your information to any other parties.
SESB disclaims all liability for all claims, losses or damage of any kind whatsoever direct or indirect whether attributed to, caused by or resulting from the process of your information by the third party.
Bill Payment
SESB shall not be liable for the followings –
• the refusal by the your credit or debit card issuer to honor or accept your request for payment;
• the disclosure of your credit or debit card details to any unauthorised person;
• any unauthorised use of your credit or debit card and/or the cards’ details; and/or
• any error in the instructions given by you during the course of transmission.
You are liable to pay all charges arising from any payment using credit or debit card regardless whether the transaction is authorised or unauthorised. Any problems or complaints with respect to your credit or debit card must be resolved by you directly with the issuer of the cards. No complaints to be made against SESB.
In any event of whatsoever reason (including but not limited to the interruption of mySESB or the dishonour of your credit or debit card payment) you shall be liable and responsible to pay the electricity bill to SESB when it becomes due including surcharge (if any). You agree and acknowledge that any payment using mySESB may not be reflected into your account automatically of which SESB needs a reasonable time in order to process and update your account accordingly. Such payment will be reflected in your next electricity bill. You are responsible to immediately notify SESB if there is any discrepancy or error appeared in your bill.
Password and Account Security
You are responsible for maintaining the confidentiality of any passwords associated with any account being used to access or use mySESB and you will be solely responsible for all activities that occur under your account. You are responsible to notify SESB immediately in the event you become aware of any unauthorised use of your account.
PWaiver
Failure to exercise any rights or provisions of the T&C by SESB shall not constitute a waiver by SESB of any such rights or provisions of the T&C.
Severability
If one or more provisions of the T&C are held to be unenforceable under any applicable law, the remaining provision shall be enforceable in accordance with its terms.
Governing Law
The Agreement shall be governed by and construed in accordance with the laws of Malaysia, excluding its conflict of law rules. The parties agree to submit to the exclusive jurisdiction of courts located in, and the venue is hereby stipulated to be Kota Kinabalu, Sabah, Malaysia.
